1. The service

Elvz is an AI social media and marketing platform operated by Elvz AI Private Limited, incorporated in India, registered office 254, Lane 20, Vijay Park, Delhi.

Elvz helps you build brand knowledge from your website, connected accounts, and imported business material; generate posts, images, and video; schedule and publish content; run messaging automations; and report on performance. Supported platforms and integrations change over time; the app is the current source of truth for what is available. Some connections listed in the app catalogue are marked as not yet available and cannot be used until they launch.

2. Eligibility and your account

• You must be at least 18 and legally able to enter a contract.
• You must provide accurate information and keep it current.
• You are responsible for everything that happens under your account, including activity by anyone you invite.
• One person or entity per account. Do not share logins or resell access.

3. Plans, credits, and billing

Plans

Elvz offers a Free plan and paid plans. The pricing page in the app is the authoritative source for current prices, credit allowances, and plan contents.

How credits work

• Actions consume credits. Different actions cost different amounts — generating video costs more than writing a caption.
• Paid plan credits refill each billing period and do not roll over.
• You may purchase additional credit packs. Purchased credits stack on top of your plan balance.
• Credits have no cash value, are not refundable except as set out below, and cannot be transferred or sold.
• Credits are consumed when an action runs. If a generation fails through our fault, we will restore the credits.

Payment

Payments are processed by Dodo Payments, which acts as merchant of record and is the seller of record for your purchase. Dodo’s terms also apply to the transaction, and Dodo handles applicable taxes. Subscriptions renew automatically at the then-current price until cancelled. We will give at least 30 days’ notice before a price increase takes effect for you. If a payment fails, we may downgrade or suspend paid features until it is resolved.

4. Cancellation and refunds

• You can cancel at any time from billing settings. Cancellation takes effect at the end of the current billing period; you keep access until then.
• We do not provide pro-rata refunds for partial periods, except where required by law.
• New subscribers may request a full refund within 7 days of a first subscription payment if fewer than 20% of that period’s credits have been used.
• Credit top-up packs are non-refundable once any credits from them have been used.
• If we terminate your account without cause, we will refund the unused portion of your current period.

5. Connected accounts

Elvz connects to two kinds of third-party account. Publishing platforms — Instagram, Facebook, LinkedIn, Threads, TikTok, YouTube, Pinterest, and Google Business Profile — where Elvz can read and, with your approval, publish. Knowledge and data integrations — cloud storage, docs and notes, calendar, e-commerce, web analytics, SEO, advertising, design, email marketing, CRM, customer support, community, CMS, and project management tools — which are read-only unless the app states otherwise.

The exact permissions requested for each are listed in our Privacy Policy. By connecting an account you agree that:

• You own, or are authorised by the owner to manage, every account you connect. This applies with particular force to shared company calendars, storage drives, ad accounts, business profiles, support desks, CRM systems, mailing lists, and Slack workspaces.
• Where a connection gives Elvz access to personal data about other people — colleagues, customers, correspondents, meeting attendees, commenters — you are the controller of that data and Elvz is your processor. You are responsible for having a lawful basis to share it with us and for any notice or consent your own obligations require.
• Your use of Elvz must also comply with each provider’s own terms and policies, including the Meta Platform Terms, the Google API Services User Data Policy, the TikTok Developer Terms, the LinkedIn API Terms, the YouTube Terms of Service, the Pinterest Developer Guidelines, and the Shopify API Terms. A breach of those may cost you your account on that platform, which is outside our control.
• Platforms can change, restrict, or withdraw their APIs at any time, and can revoke a permission we already hold. Features that depend on them may stop working. This is not a defect in Elvz and does not entitle you to a refund.
• You are responsible for messaging-frequency and consent rules that apply to automated replies and direct messages in your jurisdiction.
• You may disconnect any account at any time. See Data Deletion Instructions for what happens to imported data when you do.

Using YouTube features. By connecting a YouTube channel you also agree to be bound by the YouTube Terms of Service. Data we receive from the YouTube API is handled under the Google Privacy Policy, and you can revoke our access at any time via Google security settings.

6. Acceptable use

You must not use Elvz to:

• Break any law, or infringe anyone’s intellectual property, privacy, or publicity rights.
• Send spam, bulk unsolicited messages, or run engagement-farming schemes.
• Create or spread content that is deceptive, defamatory, harassing, hateful, or that promotes violence or self-harm.
• Generate sexual content involving minors, or content that sexualises a real person without consent.
• Impersonate a person or organisation, or fabricate quotes, endorsements, or reviews.
• Make misleading medical, financial, or legal claims.
• Manage accounts you are not authorised to manage, or connect a mailbox, calendar, drive, or business account without the owner’s permission.
• Extract data from a connected platform for a purpose unrelated to managing your own presence on it, or export platform data into a separate product or dataset.
• Reverse engineer, scrape, or attempt to extract our models, prompts, or source code.
• Resell, white-label, or provide the service to third parties without a written agreement with us.
• Probe or bypass our security or rate limits, or use the service to build a competing product.
• Circumvent credit limits or plan restrictions.

7. Your content and our content

You own your content. You keep all rights to what you upload, and to your brand materials, imported documents, and connected-account data. You grant us a worldwide, non-exclusive, royalty-free licence to host, process, transmit, and display it solely to provide the service to you. That licence ends when you delete the content or your account.

Output belongs to you. Subject to your account being in good standing, you own the content Elvz generates for you, to the extent such rights exist. Note that AI output may not be protectable by copyright in some jurisdictions, and similar output may be generated for other users.

We own Elvz. The platform, its software, design, models, prompts, and brand are ours or our licensors’. Nothing here transfers them to you. You get a limited, revocable, non-transferable right to use the service while your account is active.

Feedback. If you send us suggestions, we may use them freely and without obligation to you.

8. AI-generated output

You are responsible for what you publish. AI output can be inaccurate, biased, outdated, or unintentionally similar to existing work. Elvz drafts; you approve. Review every post, image, video, and automated reply before it goes out, and verify any factual, statistical, medical, legal, or financial claim independently.

• We do not warrant that output is accurate, original, non-infringing, or fit for any purpose.
• You are responsible for disclosing AI use where the law or a platform requires it, including platform-specific AI-content labelling rules.
• We may apply safety filters and refuse to generate certain content.
• Where automations draft replies on your behalf, you remain the publisher of those replies.

9. Availability and changes

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, and we may add, change, or remove features. If we make a material adverse change to a paid feature, we will give reasonable notice and you may cancel for a pro-rata refund of the remaining period. We may impose reasonable rate limits to protect the service, and third-party providers impose their own quotas that we must respect.

10. Suspension and termination

We may suspend or terminate your account if you materially breach these terms, if your use creates legal risk or harms other users, if payment fails and stays unresolved, if a platform requires it, or if we are required to by law. Where practical we will warn you first and give you a chance to fix the problem.

11. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELVZ IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT AI OUTPUT WILL MEET YOUR REQUIREMENTS. WE MAKE NO WARRANTY REGARDING THIRD-PARTY PLATFORMS OR THEIR CONTINUED AVAILABILITY.

Nothing here excludes a warranty that cannot lawfully be excluded.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER PARTY IS LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, EVEN IF ADVISED OF THE POSSIBILITY. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) USD 100.

In particular, we are not liable for loss or restriction of your accounts on any connected platform, content removed by a platform, or losses caused by a platform changing or withdrawing its API. These limits do not apply to fraud, wilful misconduct, or liability that cannot be limited by law.

13. Indemnity

You will indemnify and hold harmless Elvz, its directors, employees, and agents from any claim, damage, loss, or expense (including reasonable legal fees) arising from your content, your use of the service, your breach of these terms, your violation of a platform’s policies, your connection of an account you were not authorised to connect, or your infringement of a third party’s rights.

14. Governing law and disputes

These terms are governed by the laws of India. Any dispute will be referred to arbitration under the Arbitration and Conciliation Act, 1996, before a sole arbitrator, seated in Delhi, conducted in English. The courts of Delhi have exclusive jurisdiction over matters not subject to arbitration.

Before starting formal proceedings, both parties agree to attempt to resolve the dispute in good faith for 30 days after written notice.

If you are a consumer, this clause does not remove rights you have under the mandatory consumer law of your country of residence.

15. General

• Entire agreement. These terms, the Privacy Policy, and the Data Deletion Instructions are the whole agreement between us on this subject.
• Changes. We may update these terms. For material changes we will give at least 14 days’ notice by email or in-app. Continuing to use Elvz after they take effect means you accept them.
• Assignment. You may not assign these terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
• Severability. If a provision is unenforceable, the rest stays in force.
• No waiver. Not enforcing a right is not a waiver of it.
• Force majeure. Neither party is liable for delays caused by events beyond reasonable control.
• No third-party beneficiaries.
